Handbrake releases when I get in or out

Hello, I have a bit of a DANGEROUS  problem, I have only had my 2008 Expert Independence WAV ( I am up for a hip replacement ) 4 days and have almost 'lost' it 3 times. When I apply the HANDBRAKE and then slide out (because of my hip ) over the  top of the handbrake my body pushes the handbrake sideways/inward and immediately releases. If I am outside and pull the handbrake on and then if I exert horizontal pressure towards the seat, the handbrake immediately releases. On a hill this is a DANGEROUS  problem, now is it a worn handbrake mechanism and I need a new handbrake or is there a widget/wedge that attaches to the seat to stop the handbrake moving inwards or is it me and I have to get a car with the handbrake to the inside of the drivers position. ANY suggestions will be gratefully received .

Ouch, that's a scary one.

The handbrake does attach to the seat, and uses it for leverage. If you undo the seat, it takes the slack out of the cable.

Does the seat move when you pivot on it? If it does, it might just need tightening (4 or 5 torx bolts underneats, through the floor)

Or is it a sudden click, and it releases?

Not be the first time i have released mine getting in and out. Park in gear till you get the hip done.

Another option if you have it, does the button on the end of the handbrake pull out?

Mine does, and it allows me to drop the lever without it releasing the handbrake

Thanks for the replies, I think the seats have been changed at some point, there are two holes (front and Back) for the runners with the 'left' ones being used, maybe if I changed them so the seat was nearer the handbrake, although not sure what would an inch do. I don't think the end comes out but will give it a go tomorrow. And putting it in gear were I live (ventnor, fairly steep in and out of) may  not do much but WILL do it for some chance it will give me a split second longer to react, I may be a bit slow (LEAVE IT), I was hoping the answer was as simple as 'it's a faulty mechanism, son, swap it out and puts another one in'. I'll have another look at it tomorrow.

It is as if it slips off the ratchet mechanism and immediately releases the handbrake with my body weight over the top of it having to get out sharpish to reapply the handbrake, dangerously dodgy and it is scary as it has already gently bumped into a car in front that had a handbrake that works..

Parking on a hill would make me want to leave it in gear. Face downhill put it in reverse, uphill first.

I actually tested this once - I get quite paranoid about the handbrake failing overnight while I'm inside - and I didn't find it made any difference whether it was in 1st or reverse

Although I guess it would be good if the hill was steep enough to overcome being in gear, and it managed to bump start itself. I guess it would stall rather than accelerate down the hill  yikes

You in San Francisco? I have never had a motor roll when in gear

I'm not having much luck, I went to check the oil and water levels today, the bonnet release wire has snapped and from what I can find you have to do a couple hundred quids of damage to get the bonnet open, unless someone knows different.

What ever direction I'm with you and tend to leave in gear all the time on hill or not .............
What I tend to do and I gather most folk will do to is turn steering wheels towards kerb even better if I can rest them on kerb.........
It all helps with piece of mind ...........


[I've come out house to find car in street having slowly rolled off drive as I haven't applied hand brake hard enough .......
As well as  where very much older lorries and Trailers than now ... Didn't have spring brakes so no air means No brakes]............

{Usually trailers where it's moved and landing legs have colapsed... Because hand brake or wheel chock not applied}............
